North Carolina Regulatory Overview

North Carolina's Underground Storage Tank (UST) regulations, 15A NCAC 2N Criteria and Standards Applicable to Underground Storage Tanks, are administered by the NC Department of Environmental Quality (DEQ), Division of Waste Management, UST Section. The UST Section has 20 inspectors covering thousands of facilities across the state.

The focus of the UST Section's inspection program is on the proper operation and maintenance of UST equipment. Inspections cover the entire UST system including examination of tanks, lines, leak detection records, cathodic protection documentation, and all required testing forms. A trained primary operator must be designated for each facility.

Key Compliance Requirements

North Carolina DEQ requires UST owners and operators to maintain proper documentation, testing records, and trained operators for all facilities under 15A NCAC 2N.

Inspection Types

North Carolina's UST Section performs two types of inspections: compliance assistance inspections (at your request, no penalties during corrective period) and general compliance inspections (may be unannounced, with potential Notice of Violation and civil penalties for non-compliance).

Required Documents & Permits

Facilities must have a current UST operating permit and registration forms (e.g., UST-8) available at all times. The UST Inspector will review your records, observe equipment operation, and go over any compliance issues during inspections.

Trained Primary Operator

A trained primary operator is required for each facility. Training is completed through tankschool.nc.gov and does not expire unless the facility is found out of compliance during an inspection, at which point retraining is required.

Cathodic Protection Records

Maintain records of the last two three-year tests of the corrosion protection system (Form UST-7A or UST-7B), tests performed after repairs, last three 60-day readings for impressed current systems, and certification that field-installed systems were designed by a corrosion expert or Professional Engineer.

Release Detection Records

Maintain release detection records for the last 12 months including statistical inventory reconciliation records, automatic tank gauge leak rate reports, sensor status and alarm history reports, tightness test results, and third-party evaluations for each release detection method.

Spill Buckets & Containment Sumps

All spill buckets and containment sumps must be clean and dry at the time of inspection. The area above USTs must be clear with barriers removed and all covers accessible for the inspector to examine the equipment beneath.

Required Testing Forms

North Carolina requires specific testing documentation: UST-22A (Overfill Prevention Operability), UST-22B (Annual Leak Detection Operability), UST-22C (Annual Sump Visual Inspections), UST-6D/23A (Spill Bucket Integrity), UST-6F/23B (Containment Sump Integrity), UST-6G/23C (Piping Integrity), UST-6E/23D (Tank Interstice Integrity), and UST-27 (Monthly Walkthrough Inspections).

Maintenance & Repair Records

Maintain records of all maintenance and repairs to the UST system, records of any suspected release reports and subsequent investigations, and records detailing the installation and internal inspections of any lined tanks.

Corrosion Protection Verification

Records verifying that the tank and piping systems are made of a material that does not corrode must be available, or if cathodic protection has not been installed, documentation must be available for the inspector to visually observe the materials at the time of inspection.

Walkthrough Inspections

Monthly walkthrough inspections (Form UST-27) are required to visually check all UST system components including spill prevention equipment, release detection equipment, and containment areas. Annual visual inspections of containment sumps (Form UST-22C) are also required.

Release Reporting

Suspected releases must be reported to NC DEQ promptly. Triggers include failing system tests, spills or overfills exceeding 25 gallons, or soil/groundwater results indicating petroleum contamination. All investigations and outcomes must be documented.

Financial Responsibility

UST owners and operators must demonstrate financial responsibility for taking corrective action and compensating third parties for bodily injury and property damage caused by releases. Proof must be maintained and available during inspections.
